Brother Colour Laser Promotion October - December 2009
Acceptance
The acceptance of an order by the Company will be exclusively subject to these conditions which shall accordingly take precedence over and exclude any terms or conditions which the purchaser may purport to introduce - even if such conditions contain a condition similar to this one.
Pricing
All pricing are subject to VAT at the prevailing rate in force on the date of delivery. All quotations for delivery and installation, where applicable, are for the hours of 08:00 - 17:00, Monday - Friday. Installations or deliveries outside of these hours are chargeable at a prevailing installation rate. Prices quoted in a quotation or price list are subject to variation by the Company without notice. All prices are quoted in GBR.
Liability
Under no circumstances will the Company be liable to the purchaser for any loss of profits or any other indirect or consequential damage or injury attributable to defects in the goods or otherwise in the relation to the performance of any contract entered into between the Company and the purchaser.
Cancellation
The purchaser shall be liable for any non-recoverable costs incurred by the Company should the customer cancel any order it has placed within the company. All cancellations must be confirmed in writing within 48 hours of any verbal notification and in any case must be within 7 days from the date of delivery.
Delay
If the purchaser seeks to extend or delay the delivery of goods, or refuses to accept delivery at the agreed time, the Company reserves the right to invoice the purchaser from the date of the original expected delivery date and reserves the right to make a charge for disruption, loss of profit, storage costs or additional transportation costs because of the purchaser's actions.
Short or Incorrect Delivery and Defective or Damaged Goods
Claims for short delivery or delivery where the goods do not conform to the delivery note must be made within 24 hours of receipt of goods. Claims for defective or damaged goods must be made in writing within 7 days from the receipt of goods.
Returns
No returns will be accepted without the prior consent of the Company. Office Furniture and printed matter is manufactured to order and cannot be returned once ordered, except for instances of damage or defectiveness. Any accepted goods returned must be in their original packaging and in a re-saleable condition.

Payment Terms
Payment terms are strictly 30 days from the end of the month of invoice. Any variation from this must be obtained in writing from the Company. In the event that a payment becomes due and any installation is outstanding or unfinished, the invoice must still be paid by the due date with the proviso that a 5% retention may be withheld until completion.
Overdue Payments
The Company reserves the right to withdraw credit account facilities where accounts are not settled by the due date and all invoices, whether or not due for payment, become due for payment. The Company reserves the right to charge interest at 4% above the current base rate of Barclays Bank Plc on any invoice or part thereof not paid by the due date.
Title of Goods
Until the purchaser has paid the Company the full purchase price of the goods: -
The ownership of the goods shall not pass to the purchaser of the goods.
The purchaser shall be entitled to sell the goods in the ordinary course of business on the basis that to the extent permitted by the law the proceeds shall be the property of the seller.
Delivery
All deliveries are to UK mainland - couriers will not go to Scottish Islands or Ireland. Please see delivery section of Customer Services for more information.

FULL TERMS & CONDITIONS
- This promotion is only valid on direct from manufacturer new products sourced as in Clause 2. Refurbished machines, second-hand machines, any machine acquired from commercial leasing, hire purchase or similar arrangements and any machines sourced via the internet from a company not registered in the United Kingdom do not qualify; in addition any machines acquired free of charge as part of any promotion supported direct or indirect by Brother UK Ltd are also ineligible: in all circumstances it is the responsibility of the claimant to check the validity of the supplier.
- To enable us to verify your purchase, you will also be required to enter, the model number and serial number of the machine you have purchased, the details of where you purchased your machine, that is the name and telephone number or email address of the supplier or retailer. (All personal information will be processed in accordance with the Data Protection Act 1988.)
- The promotional code will activate your claim. If you fail to enter the promotional code your claim will not be registered and you will not be able to claim; Brother UK Ltd accepts no responsibility for lost claims for any reason including incorrect registration.
- A confirmation email will be received at the end of the registration process when claiming the Free 2nd / 3rd Year On-Site Warranty.
- Only one claim per machine / serial number can be made.
- All claims must be received by Brother UK on or before 15th January 2010. Any claims received after this date will be void.
- This promotion is open to all residents aged 18 or over, except employees of the promoters and their immediate families, its resellers, commercial lease partners, financial institutions and agencies or anyone else connected with the creation and administration of the promotion.
- This promotion cannot be used in conjunction with any other Brother promotion.
- Brother extended Warranty assumes the use of Brother original consumables using any compatible consumable or refills may invalidate any warranty claim.
- By entering the promotion, claimants agree to be bound by these Terms & Conditions and by any other requirements set out in the promotional material. This promotion does not affect your statutory rights.
- In all matters regarding this promotion, the decision of Brother UK will be final and binding.
- This promotion is governed by the laws of England and Wales.
